LIVIN.in — Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and LIVIN Media, a Wyoming limited liability company (“LIVIN Media,” “we,” “us,” or “our”), which operates LIVIN.in and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. By using the Service you represent that you are 18 or older and that the information you provide, including your date of birth, is accurate. We verify age at sign-up; under-18 sign-ups are blocked. You may hold only one account and are responsible for keeping your information accurate.

2. Your Account & Security

Provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly at legal@livin.in of any unauthorized use. We are not liable for losses arising from unauthorized use you fail to report.

3. Membership & Billing

• Membership may be offered in tiers; features and price are shown at sign-up.
• Paid subscriptions are billed in advance and automatically renew until cancelled.
• You may cancel any time; cancellation takes effect at the end of the current billing period.
• Prices and features may change with notice of material changes.
• Except where required by law or expressly stated, payments are non-refundable.

4. Market Mayor & MVP Partner Programs

Participation as a Market Mayor or MVP Partner is governed by a separate written program agreement that applies in addition to these Terms; revenue-share, commission, territory, and fee arrangements are set out there. Nothing on the Service creates such an arrangement except through a signed program agreement. These Terms govern your use of the Service as a member and do not create any Market Mayor, partner, employment, agency, or franchise relationship.

5. Your Content

You retain ownership of content you submit (posts, comments, vouches, photos, and similar) and grant LIVIN Media a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it on and in connection with operating and promoting the Service. You represent that you have the rights to it and that it does not violate these Terms or any law. You can remove your content, though copies may persist in backups or where others have shared it.

6. MVP Partner Offers & Third-Party Content

The Service surfaces offers, listings, and information from independent local businesses (“MVP Partners”) and other third parties. LIVIN Media facilitates discovery but is not the seller of, and is not responsible for, the goods, services, or offers provided by MVP Partners. Any transaction or dispute regarding a partner’s offer or goods is solely between you and that partner. Offer availability, terms, and honor are set by the partner and may change or end without notice. Third-party links and content are provided for convenience and are not endorsed or controlled by us, and are governed by their own terms.

7. Birthday Offer Program

If you opt in, the Service may show you birthday offers from MVP Partners in your home city during a window around your birthday. Participation is optional and you can opt out at any time in your settings. Offers are provided by the partner, vary by city and availability, are generally limited to one redemption per offer per birthday window, and are subject to the partner’s terms. We may modify or discontinue the program at any time.

8. Real Estate & Informational Disclaimer

LIVIN.in is a city-discovery and local-living information platform. It is not a real estate brokerage, lender, mortgage broker, or relocation service provider, and it does not provide real estate, legal, financial, or tax advice. Listing, market, and local information is for general informational purposes, may not be current, complete, or accurate, and is not a representation or guarantee. Where real estate or other licensed services are offered, they are provided by independently licensed professionals — not by LIVIN Media — and any relationship is between you and that professional. Verify independently and consult licensed professionals before any purchase, sale, financial, or relocation decision.

9. Acceptable Use

You agree not to: (a) violate any law or the rights of others; (b) post or transmit content that is unlawful, harassing, hateful, defamatory, obscene, fraudulent, or infringing; (c) impersonate others or misrepresent your affiliation; (d) spam, scrape, harvest, or attempt to disrupt or gain unauthorized access to the Service or circumvent security; or (e) use the Service to harm minors in any way. Content posted to the Service may be reviewed by automated and human moderation. We may remove content and suspend or terminate accounts for violations, at our discretion.

10. Privacy

Your use of the Service is subject to our Privacy Policy at livin.in/privacy, which explains what we collect and how we use it. We use your date of birth to verify eligibility and, if you opt in, to power birthday features. By using the Service you consent to the data practices described in the Privacy Policy.

11. Intellectual Property

The Service, including the “LIVIN.in” name and logo, software, design, and content we provide, is owned by LIVIN Media or its licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as expressly allowed.

12. Disclaimers

The Service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content, listing, or offer is accurate, complete, or current.

13. Limitation of Liability

To the fullest extent permitted by law, LIVIN Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

14. Indemnification

You agree to indemnify and hold LIVIN Media harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or any law or third-party right.

15. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access for violations or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Before filing any formal claim, you agree to first contact us at legal@livin.in so we can try to resolve it informally.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting the updated Terms with a new “Last updated” date or notifying you in the Service). Your continued use after changes take effect means you accept the updated Terms.

18. Miscellaneous

These Terms (with the Privacy Policy) are the entire agreement between you and LIVIN Media regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
